About this document
This disclaimer applies to everything published on this website by Group of We’s trading as WeL’nd, ABN 20 672 801 651, Credit Representative Number 554029. It forms part of our Terms of Use and should be read with them and with our Credit Guide.
General information only
The articles, guides, service pages, location pages and case studies on this site are general information. They are prepared without regard to your objectives, your financial situation or your needs. Nothing here is personal advice, and nothing here has been written with your circumstances in front of us.
Two businesses with the same tax debt and the same turnover can need entirely different structures, because the difference sits in the security available, the trading history, the reason the arrears built up and what happens next in the business. A web page cannot see any of that. A conversation can.
Before you act on anything you read here, consider whether it is appropriate for you, and speak to us or to another appropriately qualified professional. If a page describes a scenario that sounds like yours, treat it as a starting point for a conversation, not as a recommendation.
Calculators and tools are indicative
Every calculator and tool on this site produces an estimate. The result is indicative only. It is not a quote, not an offer of credit, not a pre-approval and not a promise that a lender will agree to anything.
- Results depend entirely on the figures you enter. If an input is wrong or out of date, the output is wrong.
- Calculators use simplified assumptions, which are shown with each tool. Real loans carry fees, charges, government costs and lender-specific conditions that a simple model does not capture.
- Rates and repayments are used for illustration where a figure is required. We are not quoting a rate, and no rate shown or assumed on this site is an available product.
- Interest can be calculated daily, monthly or on a different basis depending on the facility, and small differences compound over a long term.
- Borrowing power and eligibility tools do not apply any lender’s actual credit policy. Lenders assess income, expenses, credit history and security by their own rules, and those rules change.
- Results are rounded, and they do not take account of tax treatment, which depends on your circumstances and is a matter for your accountant.
No promise of an outcome
We are a credit representative, not a lender. We do not make credit decisions and we cannot approve a loan. What we can do is read your situation honestly, tell you early whether we think finance is realistic, and put the strongest version of your case in front of the lenders most likely to consider it.
We will never tell you that approval is guaranteed, that a particular rate is available before a lender has offered it, that tax debt can be cleared or written off, or that a listing on your credit file can be removed. Any of those claims should make you suspicious of whoever is making them.
Case studies and examples on this site describe situations we have worked on or scenarios constructed to illustrate a structure. Details are changed or generalised to protect client privacy. Past outcomes are not an indication of what will happen on your file, because the lending market, the lender policies and your circumstances are all different.
Not tax, legal or insolvency advice
We arrange finance. That is the licensed activity we perform, and it is where our advice stops. Several of the questions that surround business debt are outside it, and pretending otherwise would not help you.
| The question | Who to ask |
|---|---|
| How a payment, a refinance or an interest charge is treated for tax | A registered tax agent or your accountant |
| Whether to apply to the ATO for remission of interest or penalties | A registered tax agent |
| What a director penalty notice means for you personally and what your options are under it | A solicitor, together with your registered tax agent |
| Whether the business is solvent, and what your duties are if it is not | A registered liquidator or an insolvency practitioner, and a solicitor |
| Responding to a statutory demand or a winding-up application | A solicitor, urgently, because these run to a strict timetable |
| Whether to grant a guarantee or offer the family home as security | A solicitor, and independent advice for anyone signing as guarantor |
If your situation calls for one of those advisers, we will say so rather than talk around it, and we will work alongside them once they are engaged.
External sites, third parties and accuracy
This site links to lender websites, government sites such as the Australian Taxation Office and state revenue offices, and industry bodies. We include those links because they take you to the authoritative source. We do not control them, we are not responsible for their content or their availability, and a link is not an endorsement of everything on the site it points to.
Lender names, product names, logos and trade marks belong to their owners. Their appearance on this site indicates that they may sit on a panel we have access to. It does not indicate that they endorse us, that any product of theirs is available to you, or that we have assessed you for it.
We take reasonable care to keep this site accurate and current, and we date every page. Credit policy, government rules and lender appetite all move, sometimes quickly. To the extent permitted by law, we accept no liability for loss arising from reliance on information on this site that has become inaccurate, incomplete or out of date. Nothing in this disclaimer excludes any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
